In addition to actual damages arising out of breach of contract, a claim for punitive damages can also be brought. Punitive damages are based upon a tort. A tort is a civil wrong that one party inflicts upon another. Punitive damages come about when the conduct of a party is so severe, egregious, or unconscionable that the court finds it is desirable to create a remedy designed to punish. Punitive damages are awarded in addition to those given to compensate for the actual loss.
