Attorney's Fees

 

Attorney's fees are not recoverable unless authorized by the contract or statute. Contracts should state that attorney's fees are due to the prevailing party in any action brought by a trial court or any appeal. Without an attorney's fees clause, many plaintiffs may not be able to afford to bring an action to recover damages. Many pre-printed real estate sale agreements will include an attorney's fee clause.
